{"id":2874,"date":"2012-05-16T21:35:04","date_gmt":"2012-05-16T21:35:04","guid":{"rendered":"http:\/\/www.againstchildtrafficking.org\/?p=2874"},"modified":"2012-05-16T21:35:04","modified_gmt":"2012-05-16T21:35:04","slug":"guatemala-mom-seeks-mo-court-help-to-get-girl","status":"publish","type":"post","link":"https:\/\/old.againstchildtrafficking.org\/archive\/de\/guatemala-mom-seeks-mo-court-help-to-get-girl\/","title":{"rendered":"Guatemala mom seeks Mo. court help to get girl"},"content":{"rendered":"<div>\n<div>\n<div>\n<div>Source: <a href=\"http:\/\/www.google.com\/hostednews \" target=\"_blank\">http:\/\/www.google.com\/hostednews <\/a><\/div>\n<div>Posted: Wednesday,\u00a0 May 16, 2012 12:00 am<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div>\n<p>GUATEMALA CITY &#8211; A Guatemalan mother who says her child was stolen and later\u00a0 turned over to a U.S. couple for adoption said Tuesday that she will go to a\u00a0 Missouri court seeking to get her daughter back now that the U.S. State\u00a0 Department has said it doesn&#8217;t have jurisdiction to help return the girl.<\/p>\n<div id=\"blox-story-text\">\n<p>The State Department confirmed Tuesday that it has informed Guatemala&#8217;s\u00a0 government that it can&#8217;t help return Anyeli Hernandez Rodriguez because the U.S.\u00a0 and Guatemala had not signed the Hague Abduction Convention at the time of the\u00a0 alleged kidnapping in 2006.<!--more--><\/p>\n<p>&#8222;We&#8217;re obviously deeply concerned about allegations regarding stolen children\u00a0 and intercountry adoptions wherever these cases come up,&#8220; State Department\u00a0 spokeswoman Victoria Nuland said in a statement. &#8222;We consider the appropriate\u00a0 venue in the United States for pursuing this case is in the state courts.\u00a0 They&#8217;re the competent organ for holding a full hearing on the merits and the\u00a0 best interests of the child.&#8220;<\/p>\n<p>A human-rights group that has pursued the case in Guatemala&#8217;s courts on\u00a0 behalf of the child&#8217;s biological mother, Loyda Rodriguez, said the next step\u00a0 will be to find a U.S. law firm to file a civil suit charging immigration\u00a0 fraud.<\/p>\n<p>The group, the Survivor Foundation, doesn&#8217;t allege that the adoptive couple\u00a0 knew anything about the girl being kidnapped.
