SPINOSA EXAMINED THE QUESTION “ROMANIA”<\/p>\n

Nov 11 2006 – In Brussels took place on November 9 an important meeting proposed by French MEPs Jean Marie Cavada and Claire Gibault. The meeting is the following question raised by the mobilization of our coordination, coordination with other families across Europe and the U.S. (see in regard adozione2.htm on July 18). In the annex of the program. The meeting was also attended as the auditor of the European Commission Vice President Franco Frattini. We informed well in advance of the fact we have received, with the collaboration of sensitive political Italians, abundant information to the administrative. \nVery positive conclusions of Franco Frattini:
\n“The promotion and protection of the rights of children are priorities for the European Commission, which on the other hand, has demonstrated, in a passage of a recent publication (” global communication “, in July 2006), its priority to fight against the trafficking of children. ”
\nFrattini also noted the existence of the United Nations Convention on the Rights of Children, promulgated in 1989 and the Hague Convention, enacted in 1993 and now ratified by all the EU countries except Greece. He stressed that no harmonization exists at present and throughout Europe, regulating international adoptions. The Romanian law of June 2004 came into force on 01.01.2005, with the reform of adoptions. He reported his amazement relating to the provision that allows the adoption of Romanian children abroad only to grandparents, but was anxious to recall that Romania is a sovereign state. He then recalled the statistics regarding the decline of children in institutions that would (uses the conditional) rose by more than 100,000 to 28,000. As for the pipeline and pending cases, F. Frattini required to state that, personally invested from his duties to the European Commission had asked the Romanian Minister of Justice, from October 2005 to take into account much of the following criteria:
\n– The greater good of the child
\n– Publicizing without delay the decision of the (office of adoptions) to the families involved.
\nHe concluded his speech by saying, personally, feel that alternative accommodation in the institution decided by Romania, type of accommodation in host families, while legally correct, but not humanly acceptable.<\/p>\n

A BRUXELLES IL PARLAMENTO EUROPEO DISCUTE DI \u201cADOZIONE EUROPEA\u201d PER SUPERARE IL BLOCCO DEI PAESI DELL\u2019EST. ESAMINATA LA SPINOSA QUESTIONE \u201cROMANIA<\/span><\/strong><\/div>\n
<\/strong>11 novembre 2006 – <\/em>A Bruxelles si \u00e8 svolto il 9 novembre un importante incontro proposto dagli eurodeputati francesi Jean Marie Cavada e Claire Gibault. L\u2019incontro \u00e8 il seguito della questione sollevata dalla mobilitazione del nostro coordinamento, insieme ad altri coordinamenti di famiglie di tutta Europa e degli Usa (si veda in proposito adozione2.htm<\/a> alla data del 18 luglio). In allegato il programma dell\u2019incontro<\/a><\/strong>. All\u2019incontro ha partecipato come uditore anche il vicepresidente della Commissione Europea Franco Frattini. Noi, informati con largo anticipo dell\u2019iniziativa abbiamo fatto pervenire, con la collaborazione di sensibili politici italiani, copiose informazioni all\u2019On. Frattini affinch\u00e9 fosse informato del dramma \u201cRomania\u201d. Per l\u2019Italia ha partecipato la dott.ssa Melita Cavallo, ex presidente della Commissione per le adozioni internazionali, con la quale siamo stati continuamente in contatto.
\nMolto positive le conclusioni di Franco Frattini:
\n\u201cLa promozione e la tutela del diritto dei bambini sono priorit\u00e0 per la Commissione Europea, che d’altra parte, ha dimostrato, in un passo di una recente pubblicazione (“comunicazione globale “, nel luglio 2006), il suo punto prioritario di lottare contro la tratta dei bambini.”
\nFrattini ha anche ricordato l’esistenza della convenzione delle Nazioni Unite sui diritti dei bambini, promulgata nel 1989, e della convenzione dell’Aia, promulgata nel 1993 ed attualmente ratificata da parte di tutti il paesi dell’UE a eccezione della Grecia. Ha sottolineato che nessuna armonizzazione esiste, all’ora attuale e su scala europea, che regolamenti le adozioni internazionali. La legge romena del giugno 2004 \u00e8 entrata in vigore il 01.01.2005, con la riforma delle adozioni. Ha segnalato la sua meraviglia per ci\u00f2 che riguarda la disposizione che permette l’adozione all’estero di bambini romeni solo ai nonni, ma ha tenuto a ricordare che la Romania \u00e8 uno stato sovrano. Ha in seguito ricordato le statistiche per quanto riguarda la diminuzione di bambini in istituti che sarebbe (usa il condizionale) passata da pi\u00f9 di 100.000 a 28.000. Per quanto riguarda i casi pipeline e pending, F. Frattini ha tenuto a precisare che, personalmente investito dalle sue funzioni alla Commissione Europea aveva chiesto al ministro della giustizia rumena, da ottobre 2005, di tenere ben conto dei seguenti criteri:
\n– il bene superiore del bambino
\n– fare conoscere senza indugio le decisioni dell’ORA (ufficio delle adozioni) alle famiglie implicate.
\nHa concluso il suo intervento esprimendo, a titolo personale, la sensazione che le alternative alla sistemazione in istituzione decise da parte della Romania, tipo la sistemazione in famiglie d’accoglienza, siano giuridicamente corrette, ma non umanamente accettabili.<\/span><\/div>\n\n","protected":false},"excerpt":{"rendered":"
