El reciente fallo  de la Corte Constitucional acerca de la despenalizaci\u00f3n parcial del  aborto en Colombia ha puesto de nuevo sobre la mesa el tema de la  adopci\u00f3n como alternativa frente a lo que algunos consideran una afrenta  contra la vida.<\/p>\n<p>Sin embargo, sobre esta tabla de salvaci\u00f3n frente el  aborto han ca\u00eddo graves denuncias, seg\u00fan las cuales la comercializaci\u00f3n  de ni\u00f1os a familias extranjeras constituye el mayor lastre.\u00a0 Seg\u00fan Mar\u00eda  Victoria Forero, presidenta nacional de Trabajadores del Instituto  Colombiano de Bienestar Familiar, Icbf, \u201cen Colombia se est\u00e1 registrando  una perversa exportaci\u00f3n de ni\u00f1os en adopci\u00f3n, por cifras que oscilan  entre los ocho mil y los quince mil d\u00f3lares\u201d, lo que, a su juicio, ha  convertido este procedimiento en \u201cun negocio perverso\u201d.<\/p>\n<p>Forero pidi\u00f3 que se archive un proyecto que cursa en la Comisi\u00f3n  Primera del Senado sobre el C\u00f3digo de la Infancia y dijo que uno de los  aspectos negativos de la iniciativa es que permite la presencia de casas  de adopci\u00f3n privadas y agencias internacionales de adopci\u00f3n. Agreg\u00f3 que  en el pa\u00eds se deben acabar las adopciones privadas para que estas sean  estatales y no haya intermediaciones, y que la Procuradur\u00eda General de  la Naci\u00f3n tiene conocimiento de la situaci\u00f3n an\u00f3mala que se viene  presentando.<\/p>\n<p>Voceros de la Procuradur\u00eda se\u00f1alaron a El Pais que dichas denuncias  son conocidas desde hace bastante tiempo, pero se negaron a dar alguna  versi\u00f3n, aduciendo que en la actualidad desarrollan varias  investigaciones al respecto.<\/p>\n<p>Tr\u00e1fico. Sin embargo, un  hecho reciente los llev\u00f3 a preferir la adopci\u00f3n a trav\u00e9s del Icbf y  rechazar el ofrecimiento que les hizo un intermediario de un orfanato  privado nacional.<\/p>\n<p>En un di\u00e1logo sostenido a su paso por Cali, a donde vinieron para  tomar en adopci\u00f3n a Mateo, un ni\u00f1o de 3 a\u00f1os declarado en abandono  familiar por el Icbf, los esposos Ditesheim se\u00f1alaron que \u201cen Ginebra  nos abord\u00f3 un intermediario de un centro privado de adopci\u00f3n colombiano y  nos pidi\u00f3 seis mil d\u00f3lares como garant\u00eda de que tendr\u00edamos un ni\u00f1o, lo  cual nos gener\u00f3 desconfianza\u201d.<\/p>\n<p>Al ser consultada sobre el hecho, la casa de adopci\u00f3n a la  que se refirieron los Ditesheim neg\u00f3 tener representantes en Ginebra,  pero s\u00ed admiti\u00f3 que en Colombia se presenta un paulatino aumento de  tr\u00e1fico de ni\u00f1os. Los engorrosos y demorados procesos de adopci\u00f3n son el  motor del il\u00edcito negocio, que en algunas ocasiones puede mover hasta  US$60.000, cuando los intermediarios contactan clientes acaudalados en  EE.UU. y Europa, por quienes incluso llegan a sustraer beb\u00e9s a sus  madres naturales.<\/p>\n<div>\n<div>Anterior &#8211; <a href=\"http:\/\/www.fundacionesperanza.org.co\/joomla\/index.php?option=com_content&amp;task=view&amp;id=36&amp;Itemid=2&amp;limit=1&amp;limitstart=1\" target=\"_blank\">Siguiente &gt;&gt;<\/a><\/div>\n<\/div>\n<p>Modificado el ( jueves, 06 de julio de 2006 )<br \/>\nDesde 1998 la Misi\u00f3n de Adopci\u00f3n Internacional, organismo oficial  franc\u00e9s encargado de controlar el comercio de ni\u00f1os adoptados, denuncia  que en algunos pa\u00edses de Latinoam\u00e9rica existen abogados que permanecen  en contacto con los m\u00e9dicos y enfermeras que a su vez ejercen presi\u00f3n  sobre las madres para que abandonen a sus hijos, los que luego son  recluidos en orfelinatos privados.<\/p>\n<p>De tal pr\u00e1ctica no hay pruebas en Colombia, y seg\u00fan la directora  general del Centro de Adopci\u00f3n Chiquitines, en Cali, Agatha Le\u00f3n  Galatlos, los ocho orfelinatos existentes en el pa\u00eds est\u00e1n \u2018blindados\u2019  contra ese il\u00edcito. \u201cNo s\u00e9 de d\u00f3nde el sindicato de trabajadores de Icbf  saca esas versiones. Todas las casas de adopci\u00f3n privadas que hay en el  pa\u00eds mantenemos reuniones con Beatriz Londo\u00f1o, directora del Icbf, y  ella sabe c\u00f3mo trabajamos\u201d, explica la se\u00f1ora Le\u00f3n.<\/p>\n<p>El dato clave<\/p>\n<p>Firmada en La Haya, en 1993, la \u2018Convenci\u00f3n sobre protecci\u00f3n de los  ni\u00f1os y cooperaci\u00f3n en materia de adopci\u00f3n internacional\u2019 prohibe  cualquier tipo de beneficio en el proceso de adopci\u00f3n, as\u00ed como la venta  y el rapto de ni\u00f1os.<\/p>\n<p>Donaciones.Al pregunt\u00e1rsele por los recursos de sostenimiento de la  instituci\u00f3n que dirige, Agatha Le\u00f3n dice que, al igual que las otras de  su tipo, recibe recursos del Estado y donaciones, algunas de ellas  internacionales.<\/p>\n<p>Acota que ellas en ning\u00fan momento son una imposici\u00f3n para los  adoptantes ni un \u2018negocio montado\u2019, aunque admite que los recursos  gubernamentales no son suficientes para la manutenci\u00f3n del  establecimiento y que debe buscar ingresos por otras fuentes.<\/p>\n<p>\u201cLas familias adoptantes saben que necesitamos una ayuda, pero son  libres de adoptar a trav\u00e9s de una organizaci\u00f3n privada que vive de  donaciones o a trav\u00e9s del Estado (Icbf)\u201d, dice.<\/p>\n<p>Explica que este tipo de instituciones cuentan con un contrato con el  Icbf para atender determinada cantidad de ni\u00f1os entre los 2 y los 10  a\u00f1os de edad, y que ese dinero tambi\u00e9n cubre un 25% de las necesidades  de la instituci\u00f3n.<\/p>\n<p>A\u00f1ade que \u201cotra forma de financiaci\u00f3n es a trav\u00e9s de proyectos de  vacunaci\u00f3n, atenci\u00f3n m\u00e9dica y apoyo al programa educativo, as\u00ed como  apoyos de organismos extranjeros y donaciones de algunos adoptantes, que  pueden llegar a los siete mil d\u00f3lares por familia\u201d.<\/p>\n<p>Sobre el particular, Mar\u00eda Victoria Forero dice que existen agencias  internacionales que aportan bonos para los orfanatos, dirigidos  especialmente a los tr\u00e1mites de adopci\u00f3n, y que es all\u00ed donde quiz\u00e1s se  empieza a cocinar el il\u00edcito negocio.<\/p>\n<p>\u201d\u00bfQui\u00e9n sabe? Detr\u00e1s de un bono de esos pueden surgir muchas cosas\u201d,  sentencia. El defensor del Pueblo, V\u00f3lmar P\u00e9rez, dijo sobre el  particular que en la actualidad se adelanta un debate legislativo con el  fin de regular de manera integral la adopci\u00f3n.<\/p>\n<p>\u201cLa Defensor\u00eda del Pueblo ha insistido en la necesidad de que se  establezca de manera inequ\u00edvoca el control directo de la aplicaci\u00f3n de  la Convenci\u00f3n de los Derechos del Ni\u00f1o a trav\u00e9s del Icbf, para evitar la  proliferaci\u00f3n de situaciones que atenten contra los menores y que se  favorezcan intereses econ\u00f3micos o de delincuencia organizada nacional o  extranjera\u201d, dijo P\u00e9rez.<\/p>\n<p>Este diario intent\u00f3 obtener declaraciones de la directora del Icbf,  Beatriz Londo\u00f1o, sobre las graves denuncias del sindicato en materia de  adopciones, pero no obtuvo respuesta.<\/p>\n<p>El n\u00famero<br \/>\n2.058 menores de edad fueron dados en adopci\u00f3n a familias extranjeras en  el 2005, otros 1.484 fueron tomados por familias colombianas.<\/p>\n<p>Iniciando el proceso<br \/>\nPese a que adoptar un ni\u00f1o en Colombia es gratis, existe una serie de  procesos que termina representado un costo para los adoptantes. Conozca  qui\u00e9nes pueden adoptar. Aunque la adopci\u00f3n en Colombia es gratuita, para  el proceso se debe aportar una serie de documentos que representan  costos para los solicitantes.<\/p>\n<p>Una vez es asignado el ni\u00f1o, debe iniciarse ante el Juzgado Promiscuo  de Familia el proceso judicial de adopci\u00f3n, que requiere de un abogado,  escogido directamente por la familia, lo cual tambi\u00e9n representa un  costo adicional.<\/p>\n<p>Cuando la familia es colombiana o extranjera residente fuera de  Colombia debe comunicarse con la autoridad central o los organismos  acreditados (como agencias que coordinan programas de adopci\u00f3n del pa\u00eds  de residencia de los solicitantes), que brindar\u00e1n informaci\u00f3n sobre c\u00f3mo  adoptar un ni\u00f1o.<br \/>\nEntre los requisitos para adoptar est\u00e1n: tener cumplidos 25 a\u00f1os de  edad; tener al menos 15 a\u00f1os m\u00e1s que el adoptante; garantizar idoneidad  f\u00edsica, mental, moral y social suficiente para suministrar hogar seguro y  estable a los adoptados.<\/p>\n<p>Entre quienes pueden adoptar est\u00e1n:<br \/>\nLos c\u00f3nyugues y las pareja conformada por un hombre y una mujer. Los  adoptantes que tengan hijos leg\u00edtimos, extramatrimoniales o adoptivos no  tienen prohibici\u00f3n alguna para solicitar la adopci\u00f3n.<\/p>\n<p>Proceso notarial genera pol\u00e9mica<br \/>\nUn reciente y pol\u00e9mico proyecto de ley, encaminado a crear por v\u00eda  notarial la adopci\u00f3n producto de la violaci\u00f3n, el acceso carnal violento  y la inseminaci\u00f3n artificial sin consentimiento, fue presentado  recientemente por el senador Jos\u00e9 Ignacio Mesa, generando un amplio  debate a\u00fan antes de su \u2018gestaci\u00f3n\u2019.<\/p>\n<p>Seg\u00fan el senador, \u201cla idea de la propuesta es invitar a las mujeres  que tienen la decisi\u00f3n de abortar a que tengan un mecanismo de atenci\u00f3n,  de prevenci\u00f3n y de apoyo psicol\u00f3gico por parte del Estado\u201d, d\u00e1ndoles la  oportunidad de dar en adopci\u00f3n al beb\u00e9 a trav\u00e9s de la v\u00eda notarial. Su  iniciativa ha sido contemplada por muchos como un proceso mercantilista,  aunque \u00e9l asegura que no hay tal.<\/p>\n<p>\u201cNo hay forma de que mi propuesta sea mercantilista, porque la idea  es entregarle todo el manejo al Icbf, que har\u00eda una lista de elegibles  entre nacionales y extranjeros, haciendo la adopci\u00f3n m\u00e1s r\u00e1pida y  liberando a las mujeres de la presi\u00f3n de pensar en abortar\u201d, explica.<\/p>\n<p>Aclara que en esta propuesta s\u00f3lo tiene cabida el Icbf, m\u00e1s no las  casas de adopci\u00f3n privadas, de manera tal que corresponde al Estado  controlar, seleccionar a los padres adoptantes y hacer toda la  reglamentaci\u00f3n de ley.<br \/>\nAs\u00ed las cosas, una vez nazca el ni\u00f1o se escoger\u00edan los padres dentro de  una lista de elegibles del Icbf y, posteriormente, a trav\u00e9s de notar\u00eda,  se ejecutar\u00eda la entrega directa de la criatura.<\/p>\n<p>Sin embargo, el senador Carlos Gaviria D\u00edaz dijo no al proyecto por  considerarlo inconstitucional.
