(U) On April 5, Embassy received by mail a letter from <\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">Theodora Bertzi, Secretary of State for the Government of <\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">Romania<\/span><span style=\"color: #000000;\">,s (GOR) Romanian Office for Adoptions (ROA), dated <\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">March 29 and including the final report of the GOR Working <\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">Group established in June 2005 to audit pending petitions by <\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">foreign families to adopt Romanian orphans and abandoned <\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">children. Post has faxed the letter to EUR\/NCE and CA\/OCS\/CI. <\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">\u00a0<\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\"><a href=\"http:\/\/cablegate.wikileaks.org\/cable\/2006\/04\/06BUCHAREST576.html#par2%23par2\" target=\"_blank\">\u00b6<\/a>2. (U) The report shows that none of the 1,092 children <\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">identified in the pending petitions will be available for <\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">inter-country adoption, ostensibly for the following reasons: <\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">\u00a0<\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">-- 41 reintegrated into biological family <\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">\u00a0<\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">-- 12 integrated within extended family <\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">\u00a0<\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">-- 227 adopted by Romanian families <\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">\u00a0<\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">-- 17 adopted by other foreign families by the rules of the <\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">adoption moratorium (2001-04) <\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">\u00a0<\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">-- 8 under legal guardianship in Romania <\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">\u00a0<\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">-- 12 reached or will soon reach age 18 <\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">\u00a0<\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">-- 47 petitioned after a February 6, 2004 emergency ordinance <\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">suspended even exceptional approval of intercountry adoptions <\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">during the moratorium <\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">\u00a0<\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">-- 2 died <\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">\u00a0<\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">-- 6 not found in GOR,s database of orphans or abandoned <\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">children <\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">\u00a0<\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">-- 90 had petitions withdrawn by the foreign families (1 from <\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">the U.S.) <\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">\u00a0<\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">-- 132 in process of final domestic adoption <\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">\u00a0<\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">-- 415 not adoptable, protected within substitutive (sic) <\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">families <\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">\u00a0<\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">-- 83 not adoptable, placed in the protection system (their <\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">biological family did not consent to adoption before Court or <\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">the Court did not approve the opening of the domestic <\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">adoption procedure). <\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">\u00a0<\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\"><a href=\"http:\/\/cablegate.wikileaks.org\/cable\/2006\/04\/06BUCHAREST576.html#par3%23par3\" target=\"_blank\">\u00b6<\/a>3. (C) Comment: The Working Group had been expected to issue <\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">its report by the end of March, and Bertzi had announced <\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">publicly in December 2005 that none of the cases would be <\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">approved for inter-country adoption. However, the utterly <\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">non-transparent process of the Working Group and the opaque <\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">quality of the report suggest some of the children may in <\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">fact remain in non-permanent situations in which their <\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">welfare is not being adequately protected. Post believes we <\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">should continue to press the GOR to open up the Working <\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">Group,s \"conclusions\" for a transparent, objective <\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">international review and to establish a legal framework that <\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">would allow inter-country adoption for appropriate pending <\/span><\/pre>\n<pre><span style=\"color: #000000; font-size: x-small;\">cases.
